Revised Interpretation of “Federal Public Benefit” Announced

The U.S. Department of Health and Human Services (HHS) issued a Federal Register Notice that revises the 1998 interpretation of the term “Federal public benefit” as used in Title IV of the Personal Responsibility and Work Opportunity Reconciliation Act of 1996 (PRWORA). The notice establishing this revised policy interpretation takes effect immediately upon publication in the Federal Register and has a 30-day comment period that ends at 11:59 p.m. ET on Wednesday, August 13, 2025.
